  4. BASIS.  LOSE YOUR MIND DEVELOPMENT DISCLAIMS ALL WARRANTIES RELATING TO
  5. THIS SOFTWARE, WHETHER EXPRESSED  OR IMPLIED, INCLUDING BUT NOT LIMITED
  6. TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR
  7. PURPOSE. NEITHER LOSE YOUR MIND DEVELOPMENT, BRYAN T. KINK EL NOR ANYONE
  8. ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF
  9. THIS SOFTWARE SHALL BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR
  10. INCIDENTAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH
  11. SOFTWARE, EVEN IF LOSE YOUR MIND DEVELOPMENT HAS BEEN ADVISED OF THE
  12. POSSIBILITY OF SUCH DAMAGES OR CLAIMS.  THE PERSON USING THE SOFTWARE
  13. BEARS ALL RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE.

  15. This agreement shall be governed by the laws of the State of
  16. Pennsylvania and shall inure to the benefit of Loser Your Mind Developm
  17. ent and any successors, administrators, heirs and assigns. Any action or
  18. proceeding brought by either party against the other arising out of or
  19. related to this agreement shall be brought only in a STATE or FEDERAL
  20. COURT of competent jurisdiction located in Montgomery County, PA. The
  21. parties hereby consent to in personam jurisdiction of said courts.
